The RIF (French International Register) : not so Accommodating

The setting up of the French International Register in place of the Kerguelen Register was carried out at the beginning of May.

Ship-owners have been waiting for this new Register for 20 years, and it has enabled the clarification of a complex legal situation; in theory at least, no ship flying the Kerguelen flag had the right to navigate between two ports within European waters, except with a dispensation.

Today the RIF, a European register solves this problem, something which has up till now penalised the French fleet used for short sea shipping in Europe.

It also specifies the working conditions for foreign personnel and fixes the rules for minimum manning for the French personnel. In this way important work done by the Armateurs de France and the French Parliament has allowed a more complete, but at the same time a more demanding, register than that of the Kerguelen.

We do not therefore understand how this register can be classed as a ‘flag of convenience’.

This decision is both unacceptable and has heavy consequences:

·The French republic is one and undivided, even for the flag which is a national flag, whatever the register. It is therefore incorrect to assimilate the French International Register to a ‘flag of convenience’.

· The RIF has more obligations both for the ship-owner and the administration than the previous Kerguelen register which makes the classification as a ‘flag of convenience’ all the more incomprehensible.

The unions which represent the French seamen within the ITF have once again taken a more dogmatic approach by refusing such an operation to allow the RIF to remain competitive along the same lines as other European countries have created with their international register. It is clear today that the liberal options retained by our neighbours and European competitors have been fruitful as many ships, up till then registered under ‘exotic’ flags, have come back to their nation’s flag.

We can have legitimate doubts that the RIF has the same effect, because certain French ship- owners have preferred to de-flag as they are unable to meet (i) their obligations regarding French crews, (ii) their contractual obligations.

For Fouquet Sacop, which has been investing in the training of its French crews for a long time, this situation remains temporarily manageable, but causes important extra costs and weakens our commercial position: contractual obligations with our customers forbid the trading of any ships which fly a ‘flag of convenience’ which puts us in violation of our contracts, since the 3rd May 2007, date of the transfer of the ships under French International Register. Now it is therefore more urgent than ever that the French crews realise the risks of this classification for their own future and that they call on their union representatives to have this classification overturned, which is a prejudice to the future of all of us.

Master 2 : Maritime and transport law

As an Officer dispatched to the headquarters of Fouquet Sacop in the Safety department, I currently spend three days a week at the law faculty of Aix-en-Provence on a course which takes place partly within the company, partly at university. I would like to write about the scope of the course and the possible openings after this training.

Created in 1975 by Pierre Bonassies and directed by Christian Scapel, this Masters is integrated in the pole covering transport law within the law faculty of Aix-Marseille. The aim of the Masters is to train specialists of shipping law who will integrate all professions not only of the maritime world but also land, air and multimodal transport.

This course is aimed at those who have a law degree or at those who are already employed but who have an experience of the maritime sector. The training covers, among other things, general shipping law, transport law, sea insurance policies, international sales, maritime security, and maritime economy. Those who follow this training are destined to work in shipping companies (ship owners, insurance companies, ports, shipbrokers), auxiliary transport (freight forwarders, operators), appraisal (insurance / P&I, risk management), lawyers specialised in maritime law.

IT Projections

Here is some news from the IT department.
For six years now, the ships use the Stock & Purchase software to create DFS and manage their stock.

Last year, in order to improve the speed and conviviality of stock management we wrote the "Stock Manager" programme. Linked to the "Stock & Purchase" database, it allows the user to create and manage stocks of equipments and stores more efficiently.

As reports on the efficiency of "Stock Manager" were good, we decided to re-write the totality of the "Stock & Purchase" programme. This new version is currently being tested. Soon, some ships will be installed with this new version in order to test it before we distribute it to all ships.

In the future, this new version of "Stock and Purchase" will be part of the "FSM software suite" including "Pending Items", "AT forms", "VIQ", "Trading Forms" and "Claims". So, all software will be centralised.

Concerning the ships network, we will gradually migrate toward an English environment due to the internationalization of our company.

On the shore side, mail servers will be migrated toward more powerful servers following the expansion of our fleet.
To improve our ship IT developments and our break-down services, we will set up a "ship’s computer test platform" in the office. So, we’ll have the exact copy of the ship’s computer configuration and we can reproduce bugs or break-downs in order to fix them quickly.

We’re currently testing the new Microsoft OS, Windows VISTA and Office 2007 to see which improvements they could bring.

SCHOTTEL – Innovators in Propulsion Technology

SCHOTTEL, which is based in Spay on the River Rhine in Germany, is a group of companies specializing in the development, design, production and marketing of azimuth propulsion and manoeuvring units, as well as complete propulsion systems with power ratings of up to 30 MW for vessels of all sizes and types.

The main area of application for SCHOTTEL products is vessels requiring the utmost in manoeuvrability and reliability. Talking about


I have just joined the administrative and financial team of Fouquet Sacop in Marseille after more than thirteen years with Navale Française in Montpelier and Paris, where I was in charge of the accounts and the reporting. This follows the recent links between these two companies, part of the Camillo Eitzen group. A harmonization of the procedures and systems will allow new perspectives for all the departments concerned.

Future developments within Fouquet Sacop will allow me to find my position within this structure, where I received a warm welcome on my arrival in the city of Marseilles. The charm of the city and the surrounding region all help to confirm my decision in accepting to join Fouquet Sacop.

After one and a half years as receptionist, I am now working as Assistant in the Crew Department.

This new position allows me to be a link between ships, sailors and the manning agents in France and Rumania:
I am in charge of organizing the changeovers of Rumanian sailors (travel reservations, transfer service, sailor’s visas)

I appreciate this new position and its challenges and would like to take this opportunity to thank all those who rely on me for this new position
